Kissimmee Foreclosure Litigation

Florida law does not require that your lender notify you before starting the foreclosure process, but individual mortgages or deeds of trust may require it.  The foreclosure process beings when your lender files a foreclosure action and records a notice of lis pendens against your property.

Your lender will notify you and the other affected parties of the foreclosure action in person or sometimes by mail or publication.  If you fail to respond to the foreclosure action with the specified amount of time, you will be found in default and your lender may ask for a final ruling.

If the court rules against you, the final ruling includes the total amount owed and the foreclosure sale date.  Once the final ruling is issued, the clerk issues a notice of sale, which contains the location, date and time of the sale.  The notice is published, and a foreclosure sale is usually held 20 to 35 days after the ruling.

You have the right to redeem the property any time before the sale by paying the total amount owed to your lender; however, there is no right to redeem after the certificate of sale is issued to the winning bidder.
